Do you know that you have the right to refuse dangerous work under Section 128 of the Canada Labour Code Part II?

  • An employee has the right to refuse to do a job if that worker has reasonable cause to believe that:
    • There is a condition at work that is a danger to himself or herself;
    • The use or operation of a machine or thing at work presents a danger to himself/herself or a co-worker; or
    • The performance of an activity constitutes a danger to the employee or to another employee. {Section 128.(1)}
  • Any employee, subject to Part II of the Canada Labour Code has the right to refuse dangerous work as long as:
    • The refusal does not put the life, health or safety of another person directly in danger;
    • The danger in question is not a normal condition of employment. {Section 128.(2)}
  • Part II of the Canada Labour Code provides financial protection to employees who are affected by a stoppage of work when an employee exercises the right to refuse dangerous work. {Section 128.1(1)(4)}

You always have the right to refuse unsafe work.
