CRA Pension Transfer Litigation Update

The Institute has filed, along with the Public Service Alliance of Canada (the Alliance) a class action in the Ontario Superior Court of Justice. The Action relates to the Employees who ceased employment with the Ontario Ministry of Revenue and accepted employment with the Canada Revenue Agency as part of the Ontario Sales Tax Administration Reform Process. The claim alleges negligence, breach of fiduciary duty and negligent misrepresentation in relation to various federal and provincial defendants' failure to advise members of changes to actuarial assumptions that would affect their pension transfer beyond a certain date. The action seeks damages.

As is the case in any class action, the first step is for the Court to identify the classes and sub-classes of plaintiffs. A judge has been appointed to manage the case and a case conference hearing is scheduled for November 25, 2015.
